Tell Government to Recognize Broadcaster Rights.

Freedom of speech is a fundamental right recognized by the United States Constitution.


Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


The First Amendment—like the Second Amendment—accrues equally to each individual citizen; broadcasters enjoy the same free speech protections enjoyed by all citizens, including print journalists, Internet commentators ,academics, and political advocates irrespective of any law, regulation or policy of any governmental entity; the burden of proof rests entirely upon government to justify even the slightest abrogation of these rights.


Government officials and elected officials—especially the President—must take extraordinary steps to avoid even the appearance that they will politically retaliate or wield government powers against broadcasters who disagree with their viewpoints and policies.


Government licensing of broadcasters must never be used for the harassment of broadcasters who promote, or the interference with any broadcast that promotes, the superior benefits to society of monogamous, heterosexual marriage between one man and one woman, or to promote exclusive Religious claims; this principle should apply to any sincere exercise of religion (regardless of whether compelled by, or central to, a system of religious beliefs).


Broadcasters’ property rights are hereby reaffirmed, and these rights shall not be abridged by unwarranted government takings, including any imposition of fees by the United States Copyright Board or any other legislative or governmental entity for any over the air music play that promotes music sales.

Take Action Now to Protect Radio and Free Speech


Radio Tax (Performance Tax)


Members of Congress have proposed a major new tax on radio that, if passed, will be devastating to the industry. Foreign-owned record labels want a bail-out from the U.S. radio industry – which is already struggling in the current economic crisis.


Fairness Doctrine


Democrats in Congress have made no secret of their desire to bring back the draconian Fairness Doctrine. If reinstituted, the un-Fairness Doctrine would limit free speech and destroy talk radio—the one area in today’s media environment where conservatives have a strong voice.


Big Brother “Localism”


Under the guise of providing local “accountability”—the FCC has proposed a system that could make privately-owned radio companies subject to decision-making bodies who do not represent a station’s target audience. This regulatory measure has been labeled a back-door Fairness Doctrine.


Hate Crimes/Hate Speech


Leading voices in the new congressional majority are advocates of new and greatly expanded hate crimes/hate speech legislation. If passed, it is widely feared that this will serve to limit free speech—both on and off the radio. In Canada, for example, similar legislation has led to severe restrictions on what a Christian minister can speak about on the radio.
